Member/Guest Agreement
Participant Information
1. Assumption of Risk
I understand and acknowledge that participation in any Fairway Bays booking involves physical activity and the use of golf equipment, golf simulator technology, and shared facilities. I voluntarily assume all risks and risks of my guests associated with my participation, including but not limited to:
● Physical injury from swinging golf clubs or contact with equipment
● Injury caused by other participants or spectators
* Injury by balling coming out of another bay or my own
● Damage to personal property brought onto the premises
● Any other risks inherent to the activity and the facility
2. Release of Liability
In consideration of being permitted to participate in this Event, I, on behalf of myself, my heirs, executors, and
assigns, hereby release, waive, discharge, and covenant not to sue Fairway Bays, Courson Solutions LLC, their
owners, officers, employees, agents, and volunteers (collectively "Released Parties") from any and all claims,
demands, losses, or liabilities arising out of or in any way related to my participation in the Event, including claims
arising from the negligence of the Released Parties.
This release includes, without limitation, any claim for:
● Bodily injury, illness, or death
● Damage to or loss of personal property
● Any financial loss or other consequential damages
3. Facility Rules & Conduct
I agree to comply with all Fairway Bays facility rules, tournament rules, and the directions of Fairway Bays staff at
all times. I understand that Fairway Bays reserves the right to remove any participant from the Event and facility
for unsafe behavior, property damage, or failure to comply with these terms, without refund of any tournament
fees.
4. Indemnification
I agree to indemnify and hold harmless the Released Parties, Fairway Bays LLC, from any claims, damages, losses, or expenses
(including reasonable attorneys fees) arising out of or resulting from my participation in the Event, including any
damage I cause to facility equipment, property, or other participants.
6. Governing Law
This Agreement shall be governed by the laws of the State of Florida. If any provision of this Agreement is found to
be unenforceable, the remaining provisions shall continue in full force and effect.
Acknowledgment & Signature
BY CHECKING THE BOX, I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT IN ITS ENTIRETY, THAT I FULLY
UNDERSTAND ITS TERMS, AND THAT I AM SIGNING THIS AGREEMENT VOLUNTARILY AND OF MY OWN FREE
WILL.
This waiver is valid for the booking time I've selected and there afterwards in future bookings.
